Who we are and what this policy covers.

Bingil Bay Distillery (“Bingil Bay Distillery”, “we”, “us” or “our”) operates a working distillery, tours and tastings, direct-to-customer spirit sales, the Distillers Club and the Bingil Bay Distillery website.

This policy explains how we collect, hold, use and disclose personal information when you visit our website or distillery, book a tour, contact us, join the Distillers Club, attend an event, purchase from us or otherwise deal with us.

We handle personal information consistently with applicable Australian privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply.

“Personal information” means information or an opinion about an identified individual, or an individual who is reasonably identifiable.

The information we may collect.

The types of personal information we may collect include:

  • your name, email address, telephone number and contact details;
  • tour, tasting, event or group-booking details;
  • your communication history, enquiries, feedback and correspondence;
  • Distillers Club membership, consent and communication preferences;
  • transaction, payment and purchase information processed through our payment providers;
  • age-confirmation information where reasonably required for alcohol service or sales;
  • limited accessibility, dietary or health-related information you choose to provide where needed to safely accommodate a visit;
  • competition, event, survey or promotional-entry information;
  • photographs or video where you have consented, or where appropriate notice has been provided at an event;
  • website-use data such as IP address, device type, browser, referring page, pages viewed, approximate location and interaction data; and
  • any other information you choose to provide to us.

We generally collect information directly from you through online forms, booking systems, email, telephone, in-person interactions and event registrations. We may also receive information from a person making a group booking, our technology providers, social platforms or publicly available sources where lawful and appropriate.

Sensitive information

We will only collect sensitive information where it is reasonably necessary, you consent, or collection is otherwise permitted by law. Please avoid providing medical or other sensitive details unless they are genuinely required for your visit or safety.

Why we collect and use personal information.

We may use personal information to:

  • manage tour, tasting, group and event bookings;
  • respond to enquiries and provide customer service;
  • process payments, purchases, refunds and transaction records;
  • confirm eligibility for alcohol service or purchase where required;
  • operate the Distillers Club and send communications you have requested;
  • provide information about limited releases, new spirits, events and distillery news;
  • personalise and improve our website, services and visitor experience;

  • manage safety, security, insurance, fraud prevention and record keeping;

Where practical, you may deal with us anonymously or using a pseudonym. However, we may be unable to complete a booking, provide a requested service, process a transaction or respond fully without certain identifying information.

Direct Marketing

Distillers Club, email and promotional communications.

When you join the Distillers Club or otherwise consent to receive marketing, we may contact you about limited releases, allocation opportunities, new spirits, selected events, tours, tastings and distillery news.

We do not automatically add a person to marketing lists merely because they make a general enquiry or complete a one-off booking, unless they have consented or applicable law otherwise permits the communication.

You can unsubscribe at any time by using the unsubscribe link in an email, following the opt-out instructions in a message or contacting us. Unsubscribing from marketing will not prevent us from sending service communications that are reasonably necessary for an existing booking, transaction or enquiry.

We do not knowingly direct alcohol marketing to people under 18.

Our website may use cookies, pixels, local storage and similar technologies to keep the website functioning, remember preferences, understand website use, improve performance and measure marketing effectiveness.

Some information may be combined with information held by analytics, advertising, social-media or email-service providers.

You can manage cookies through your browser settings and any cookie controls presented on our website. Blocking some cookies may affect website functionality. Third-party websites and platforms have their own privacy and cookie practices, which we do not control.

When information may be shared.

We may disclose personal information to:

  • website-hosting, booking, payment, email, CRM and customer-service providers;
  • analytics, advertising, social-media and digital-service providers;
  • professional advisers, insurers, accountants, auditors and legal advisers;
  • contractors and suppliers who assist us to operate the distillery or deliver an event;
  • government, regulatory, law-enforcement or emergency authorities where required or authorised by law; and
  • a purchaser, adviser or relevant party in connection with a proposed or completed business sale, restructure or transfer.

Depending on the service you use, our providers may include platforms such as Shopify, Square, Klaviyo, Google and Meta, together with other providers appointed from time to time. Those providers process information under their own terms and privacy policies.

We do not sell or rent personal information to third parties.

Overseas processing

Some service providers may store or process information outside Australia, including in the United States and other countries in which they or their infrastructure providers operate. Privacy laws in those locations may differ from Australian law. Where applicable, we take reasonable steps in relation to overseas disclosures as required by Australian privacy law.

Security, retention and data incidents.

We take reasonable administrative, physical and technical steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

No method of internet transmission or electronic storage is completely secure. You should take care when sending information electronically and keep booking, account and device credentials secure.

We retain personal information only for as long as reasonably necessary for the purpose for which it was collected, for legitimate business and record-keeping needs, or as required by law. Information that is no longer required will be destroyed or de-identified where reasonably practicable.

If a data breach occurs, we will investigate and respond. Where the Notifiable Data Breaches scheme applies and a breach is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner as required.

You may contact us to request access to personal information we hold about you, or to ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. We may need to verify your identity before acting on a request.
